Pursuant to due call and notice thereof, Mayor Rich Bauer called the Zumbrota City Council to order at 6:00 p.m.  PRESENT:  Mayor Rich Bauer; Council members Dale Hinderaker, Sara Durhman, Brad Drenckhahn and Tina Hostager. Others present: City Administrator Neil Jensen,   City Attorney Matt Rockne, Public Works Director Mike Olson, Police Chief Pat Callahan, Police Officer Shannon Clemenson, Sandy Hadler, Brian Haugen, John Breene (DFA), Lucy Schwarz (DFA), Brian Thompson (DFA), and NewsRecord reporter Tawny Michaels.  


The meeting opened with the Pledge of Allegiance.



Motion Hostager, second Drenckhahn to adopt the agenda.  Approved 5-0-0.



Motion Hinderaker, second Durhman, to approve the regular City Council meeting minutes of December 18, 2014, with a correction.  Approved 4-0-1 (Hostager abstaining).



Motion Drenckhahn, second Durhman to approve the accounts payable of $73,380.36.

Approved 5-0-0.

Mayor Bauer opened the public hearing for the 2015 Fee schedule at 6:05 pm.  The fee schedule is as listed:

He asked for questions, and finding none the hearing was closed at 6:07 p.m.


Unfinished Business:

7-A.  DFA Penalty Waiver Request

Jensen and the Council had received notification that DFA was appealing the doubling of fines of their October and November bills.  The Council discussed reducing the fines.  Mayor Bauer stated he would be in favor of not doubling the penalties for October and November and removing the sludge fee.  Staff has been doing research to see what other communities charge for these types of industry for BODs and TSSs.  There is a wide range of charges and the City of Zumbrota does not seem to be keeping in step with the other cities.  Bauer said he would like to see the penalty fee increased from $4.50 to $6.00 per pound and would like to set a committee to review the other charges.  Jensen, Bauer and Drenckhahn will form the committee and get back to the Council with their recommendation.  Drenckhahn was still in favor of doubling the fines as he believed it was within the City’s right to do so.  Hinderaker said he thought the notification process was not clearly defined.  Hostager said she felt like progress was being made and Durhman stated the bottom line was that residents are sick of the smell and DFA needs to fix it. 


Motion Hinderaker, second Durhman to reduce the October $29,205 fine to $14,602.50 and review the TSS and BOD charges.  Approved 4-1-0 (Drenckhahn opposed).


Motion Drenckhahn, second Hostager to remove the sludge fee on the November billing.  Approved 5-0-0.


Motion Hinderaker, second Hostager to reduce the November penalties from $7,177.50 to $3.588.75 with the understanding fees will be examined at the next meeting.

John Breene of DFA thanked the Council for their decision and their time. 


7-B.  Comprehensive Plan Update

Council was asked to review the list of steering committee members from the previous comprehensive plan and get back to staff with suggestions for this committee.  This item was tabled until the next meeting. 



8-A.  Resolution 2015-01 Designate Official Depositories

Motion Hostager, second Drenckhahn to approve Resolution 2015-01 Designate Official Depositories as the Bank of Zumbrota and Edward Jones.  Approved 5-0-0.


8-B.  Resolution 2015-01 Designate Official Publication

Motion Hostager, second Drenckhahn to approve Resolution 2015-02 Designate Official Publication as the NewsRecord.  Approved 5-0-0


8-C.  2015 Fee Schedule

Hostager requested she be removed from the appointment to the Library Board.  Motion Drenckhahn, second Hinderaker to approve the 2015 annual appointments with the exception of Hostager’ s appointment to the Library Board and to allow the Mayor to appoint someone in her place.  Approved 5-0-0.


8-E.  2014 Audit Engagement Letter

Motion Durhman, second Hinderaker to approve the 2014 Audit Engagement letter from Scanlon, Murch and Associates.  Approved 5-0-0.


8-F.  Wastewater Facility RBC Bearing Replacement Approval

A bearing at the WWTP is failing prematurely.  The bearing replacement is $4,275 and the cost to get the crane to replace it is $11,973.  Olson suggested that the other bearing adjacent to this one be replaced at the same time in order to avoid another crane cost.  Motion Hinderaker, second Durhman to approve the replacement of the two RBC bearings for a total cost of $20,523.  Approved 5-0-0.  


8-G.  CIS Record Management Hardware Approval Police Department

Chief Callahan requested the Council approve purchase of CIS record management hardware to further utilize the current hardware and streamline the handling of evidence.  Motion Hinderaker, second Durhman to approve the purchase of the CIS record management hardware for a cost of $1,142.  Approved 5-0-0.

City Administrator Neil Jensen

Asked the Council members to let him know if they wished to attend a SELM meeting on January 23rd.


Public Works Director Mike Olson

Informed the Council he will be bringing proposals for the WWTF roof to the next meeting.


Police Chief Pat Callahan

Gave an update about how his transition to Police Chief is going.


City Council Member Brad Drenckhahn:

Said the Park Board had been informed it is eligible to receive up to $5,000 in SHIP grants for the biking system in Zumbrota.  He also said Zumbrota Ford and the Zumbrota Fire Department have offered to partner to get boards on the ice skating rink so it can be used for hockey.
