CITY OF ZUMBROTA
COUNCIL MEETING MINUTES
OCTOBER 1, 2015
Pursuant to due call and notice thereof, Mayor Richard Bauer called the Zumbrota City Council to order at 6:00 p.m. PRESENT: Council members Brad Drenckhahn, Dale Hinderaker, and Tina Hostager. Absent Sara Durhman. Others present: City Administrator Neil Jensen, Police Chief Pat Callahan, City Accountant Kim Simonson, City Attorney Matt Rockne, Community Development Director Dan King, Library Director James Hill, Sandy Hadler, Brian Haugen, Jim Wedge, Steve Fenlon, Dave Chalberg and Jon Chalberg.
The meeting opened with the Pledge of Allegiance.
AMENDMENTS/ADOPTION OF AGENDA
Motion Drenckhahn, second Hostager to adopt the agenda. Approved 4-0-0.
Motion Hinderaker, second Drenckhahn, to approve the meeting minutes of September 17, 2015. Approved 3-0-1 (Hostager abstaining).
Motion Hinderaker, second Drenckhahn to approve the accounts payable of $36,006.50.
6-A. Approving a Project by St. Francis Health Services of Morris, Inc. and Consenting to the Issuance of Obligations by the Cities Chisholm and Morris, Minnesota
Mayor Bauer opened the public hearing at 6:05 pm. Steve Fenlon, representing St. Francis, explained at the public hearing that St. Francis is refinancing $9.95 million dollars in improvements for their facilities in Zumbrota, Duluth and Chisholm. This public hearing needs to be held to comply with IRS rules and the City of Zumbrota is not a party to the transaction. There was no comment from the public. Mayor Bauer closed the public hearing at 6:10 pm.
7-A. An Ordinance Amending Zumbrota City Code Section 72.06 Interference with Snow Removal; Towing
The Council reviewed the changes to the ordinance. The revisions state automobiles must be removed from streets during or after a snowfall when there is accumulation of ice, snow or similar debris. There are some exceptions to the winter parking rules. Motion Hinderaker, second Drenckhahn to approve the changes to Ordinance 2015-04 An Ordinance Amending Zumbrota City Code Section 72.06 Interference with Snow Removal; Towing. Approved 4-0-0.
7-B. Solid Waste Contract Discussion
The solid waste committee has not met yet but Jensen proposed the following to address some of the concerns held by the commercial district: lowest bid meeting the specifications would be given the residential contract and then the two lowest bidders would have the opportunity to service the business community. In effect, the residential would be one hauler and the commercial would be two haulers. Hinderaker said this may make business owners happy to have a choice. Bauer suggested perhaps a clause be added that if a hauler goes out of business then the City can issue a second license. Also there was discussion on where the waste goes. Currently 50% of the waste goes to the Red Wing incinerator and 50% goes to the landfill of choice. Council directed staff to prepare bid sheets asking for comparisons between haulers landfill of choice, 50% incinerator/50% landfill of choice and 100% incinerator. Also, the Council would like a tonnage report from the hauler.

Motion Drenckhahn, second Hinderaker to approve Resolution 2015-11 Approving a Project by St. Francis Health Services of Morris, Inc. and Consenting to the Issuance of Obligations by the Cities of Chisholm and Morris, Minnesota. Approved 4-0-0.
8-B. Chalberg Variance Request to Zoning Code Section 3, Subdivision 3A(3)b
Jon and Dave Chalberg had made a request asking for a variance to the 10 foot setback from other buildings on the lot. In order to meet the 5 foot property line setback the garage would be closer than 10 feet to the house. The Planning Commission recommended Council approval of this variance. Motion Hostager, second Hinderaker to approve the Chalberg Variance Request to Zoning Code Section 3, Subdivision 3A(3)b. Approved 4-0-0.
Council Member Dale Hinderaker:
Talked about some of the increased media push to recruit Festival volunteers. Also he had received the quotes for the employee health insurance for 2016 and they looked promising.
The Zumbrota City Council meeting was adjourned at 6:39 p.m.
Neil Jensen City Administrator
