March 16, 2006 Council Minutes


          REGULAR MEETING     March 16, 2006   6:00 P.M.      TOWN HALL


Pursuant to due call and notice thereof, Mayor Rich Bauer called the Zumbrota City Council to order at 6:00 p.m.  PRESENT:  Mayor Bauer, Councilmembers Willard Eberhart, Betty Jo Grothe, Doug Borgschatz, Michael Feil.  Others present: City Administrator Neil Jensen, City Accountant Kim Simonson, Police Chief Gary Selness, City Attorney Matt Rockne, City Engineer Bill Angerman, Jim Wedge, Brian Haugen, Allen Falk, Dale Hinderaker, Zumbro Valley Construction Jonathan Pahl and Chris Stolp.


The meeting opened with the Pledge of Allegiance.




               Motion Grothe, second Borgschatz, to adopt the agenda.  Carried 5-0-0.



            Motion Borgschatz, second Feil, to approve the regular meeting minutes of 3/02/06.      Carried 5-0-0





Motion Feil, second Eberhart to approve the accounts payable of $55,658.49.  Carried 5‑0‑0





Unfinished Business:


7-A  Police Department:

Mayor Bauer reported that there is a union negotiation meeting scheduled for March 22nd at 2:30.  Discussion was held on the School Resource Officer and the request for Rodger Rueckert to come to a council meeting and discuss the benefits of the officer. Also a request was made for the minutes of the quarterly SRO meeting be available to the council.  City Administrator Neil Jensen reported that Chief Selness, Rodger Rueckert, ZM School Superintendent, Duane Hofschulte, Mazeppa City Administrator, Wabasha County Sheriff Rodney Bartsh met to discuss the budget for the SRO in the upcoming budget cycle.  It was reported that there was a positive response from the group.








New Business:


8-A:  3.2 Beer/Wine License Aroma’s:


Stacie Anderson from Aroma’s, 365 South Main is requesting a 3.2 Beer and Wine License.  Upon approval they will send the application to the State of Minnesota for inspection and final approval.  The city has received liability insurance from Aroma’s. 


            Motion Eberhart, second Grothe to approve the 3.2 Beer and Wine License. Carried 5-0-0


8-B  Tax Increment Financing Discussion:


A discussion was held in regards to the recent requests for Tax Increment Financing in the Jacobson Commercial Park.  City Administrator Neil Jensen reported that David Drown the cities financial advisor will be at a special EDA meeting scheduled for March 22 at 7:00 a.m.  Mayor Bauer asked the council if they had any comments as to TIF and the use of it in the City of Zumbrota.  Dale Hinderaker President of the EDA commented on the basic guidelines of TIF and certain situations that meet the criteria. He stated that the city needs to look at the larger picture.  Councilmember Borgschatz stated that the city should set certain criteria and if the applicant mets 3 out of 5 then the council will look at it.  Mayor Bauer requested the history of TIF and what they have done before in the city.  Mayor Bauer stated that it is a tool that pits city against city and is a mode of competition for city’s to increase economic development.  Councilmember Feil stated that we should look at the taxable value and not just in the Jacobson Commercial Park but in the whole city.  Councilmember Eberhart stated that it won’t do the city any good to do all TIF.  We can’t expect the old part of town to pick up the tab Councilmember Eberhart stated.  We still have to maintain these areas.  Councilmember Borgschatz stated that we can revisit the set criteria if the lots won’t sell and take them on a case by case item.  The council was in agreement to schedule a joint meeting with the EDA on Wednesday March 22nd at 7:00 a.m..


            Motion Borgschatz, second Feil to set a joint meeting with the EDA on March 22,2006 at         7:00 a.m. to discuss Tax Increment Financing.  Carried 5-0-0


 8-C.  Approve Community Development Director:


City Administrator Neil Jensen reported to the council the applicant that the hiring committee selected and has accepted for the Community Development Director position.  Crystal Foust has accepted the position and will start on April 6th, 2006.  The position starts at $19.66 per hour and will have all other city benefits.  City Administrator Neil Jensen stated that he is excited to welcome Crystal Foust to the City of Zumbrota. 


            Motion Grothe, second Feil to approve Crystal Foust as the Community Development   Director starting at $19.66 per hour and with all other city benefits.  Carried 5-0-0



8-D.  Zumbro Valley Construction:


Mayor Bauer introduced Jonathon Pahl and Chris Stolp from Zumbro Valley Construction the developer’s for the former Grover Auto site. Pahl explained that the apartment building being presented for review is a 16 unit two story 55+ community.  The building would have 1 or 2  ADA accessible  units with a elevator to the second story.  There will be a total of 5-3 bedroom and 11-2 bedroom units with each having a detached garage. Covered Bridge Estates is the name given to the apartments in association with the Covered Bridge. Mayor Bauer thanked them for coming. 



8-E.  Resolution 2006-05 Goodhue Pioneer Trail Support:


The Pioneer Trail Committee requested support for the Pioneer Trail.  As in the past the City of Zumbrota has supported the Pioneer Trail for its long term economic and tourism benefit to the community. The trail offers transportation alternatives and long term health benefits associated with the growing problem with obesity.


            Motion Grothe, second Eberhart to approve Resolution 2006-05 Declaring Support of the        Goodhue Pioneer Trail and the Provisions of Capital Funding for MN State Trails.            Carried 5-0-0




City Administrator Neil Jensen:

City Administrator Neil Jensen reported on the Grover Site.  The contaminated soil and underground storage tanks have been excavated and the basement has been partially filled with engineered fill.  


City Accountant Kim Simonson:

No Report


Police Chief Selness:

Police Chief Selness reported that in the last snow there were 4 warning tickets, 5 snow tickets, and 5 towed vehicles.  Also there is a 800 megahertz meeting in Goodhue on March 28th.


City Engineer Bill Angerman:

City Engineer Bill Angerman reported the he is reviewing the 4th addition of Highlands and will be addressing storm water issues along with 435th Street.  Also the city will implement a Infrastructure Release form at the end of each development project to ensure a completed project.
