AUGUST 6, 2009 6:00 P.M.    



Pursuant to due call and notice thereof, Mayor Rich Bauer called the Zumbrota City Council to order at 6:00 p.m.  PRESENT:  Mayor Rich Bauer; Council members Doug Borgschatz, Betty Jo Grothe, Dale Hinderaker and Sara Nygaard. Others present: City Administrator Neil Jensen, Public Works Director Rick Lohmann, Community Development Director Dan King, City Accountant Kim Simonson, Police Chief Gary Selness, City Attorney Matt Rockne, Library Director James Hill, Jim Wedge, Brian Haugen, Officer Gene Leifeld, Lynn Wingfield, Colleen O’Reilly and NewsRecord Reporter Sandy Hadler.


The meeting opened with the Pledge of Allegiance.



Motion Borgschatz, second Grothe to adopt the agenda with the addition of item “8-D  Wet Well Change Order”.  Approved with the addition, 5-0-0.



Motion Hinderaker, second Borgschatz, to approve the regular meeting minutes of July 16, 2009.  Approved 4-0-1 (Nygaard abstaining).


Motion Hinderaker, second Grothe to approve the July 16, 2009, Work Session Minutes. Approved 4-0-1 (Nygaard abstaining).



Motion Nygaard, second Hinderaker to approve the accounts payable of $53,042.46. 

Approved 5-0-0.


Public Comment: 


Public Hearings/MeEtings: 

Ms. Wingfield and Ms. O’Reilly addressed the Council expressing their concern about the release of Stan Shelstad, a convicted level 2 sex offender.  Ms. O’Reilly asked why there had not been a public hearing about the release.  Chief Selness explained the State of Minnesota had given Shelstad a level 2 designation and therefore there could be no public hearing.  Selness also stated he had informed all the day cares and schools in the area and he and his officers were monitoring Shelstad as well as being in contact with his parole officer.  Wingfield asked what she could do to inform people about Shelstad, stating she feels he is a danger to area children.   Chief Selness told her she need to be careful to not harass Shelstad.  Mayor Bauer advised her to seek legal counsel so as to avoid any issues.  Selness said he could supply the women with the number of the parole officer.  The public portion of the meeting closed at 6:10 p.m.


Unfinished Business:

7-A.  Liquor Ordinance Amendment

Motion Borgschatz, second Grothe to approve the liquor ordinance amendment. 

Approved 5-0-0.


7-B.  3.2 Beer and Wine License (State Theatre)

Motion Hinderaker, second Grothe to approve the 3.2 Beer and Wine License for the State Theatre, limited to live, dramatic, musical and dance performance.  Approved 5-0-0.




8-A.  Pioneer Trail Update

Roxanne Bartsch gave the Council an update on the Progress on the Goodhue Pioneer Trail.  The work on the trail began in 1994 and has been slow and steady.  So far the Trail has received over $3,000,000 in funding.  They have partnered with the Parks and Trails Organization for land acquisition.  Approximately 4 miles of trail from Zumbrota northward is owned by the organization.  The future plan is to finish the Zumbrota Goodhue link with the help of funding from the 2010 Bonding Bill.  Bartsch said the Trail would like to show there is community support for the project and had requested a $500 donation from the City.  The EDA had expressed their full support.  Motion Grothe, second Hinderaker to approve a $500 donation to the Goodhue Pioneer Trail.  Approved 5-0-0.


8-B.  Goodhue County GIS Agreement

No motion occurred.  Item will be dropped from the agenda.


8-C.  2010 Budget

 The 2010 Budget was reviewed.  Staff asked Council to review and ask any questions if they think adjustments should be made. 


8-D.   Wet Well Rehab Change Order

During the sandblasting of the wet well a portion of pipe sprung a leak.  Upon further examination it was found there were areas of pipe which may be prone to rupture. To prevent this Public Works Director Lohmann looked at options for repair.  He received two from the Wapasha Construction Company.  Option 1 would cost $14,516.25.  Option 2 would cost $14,248.50.  Lohmann explained Option 1 would probably be the best fix.  Motion Borgschatz, second Grothe to approve the Change Order Option 1 pending approval from the City Engineer.

Approved 5-0-0.




Public Works Director Rick Lohmann;

Reported the crosswalk signs have been installed on Main Street.


Community Development Director Dan King;

Said the State Demographer had contacted his with the 2008 population of Zumbrota.  The population was 3,172.


Police Chief Gary Selness;

Reported National Night Out was a success and thanked Officer Gene Leifeld for his efforts in coordinating the event. 


Mayor Rich Bauer;

Said he, Council Member Borgschatz and City Administrator Jensen had their first meeting with the Police Union representatives.  The next meeting will be August 27th.
