          REGULAR MEETING     May 19, 2005   6:00 P.M.      TOWN HALL


Pursuant to due call and notice thereof, Mayor Rich Bauer called the Zumbrota City Council to order at 6:00 p.m.  PRESENT:  Mayor Bauer. Councilmembers Doug Borgschatz, Willard Eberhart, Betty Jo Grothe, Dave Benson.  Others present: City Administrator Neil Jensen, City Accountant Mary Rohe, Community Development Director Angie Bersaw, Public Works Director Rick Lohmann, City Attorney Matt Rockne, Police Chief Gary Selness.

Reporter Sandy Hadler, Paul Qualy, Jim Wedge. Arriving intermittedly Police officers Bill Matthews, Gene Leifeld, Gary Schroeder.


The meeting opened with the Pledge of Allegiance.



              Mayor Bauer added Gravel Road Maintenance to new Business Item 8-J

               Motion Grothe, second Borgschatz, to adopt the agenda, as amended.  Carried 5-0-0.




            Motion Borgschatz, second Grothe, to approve the regular meeting minutes on 5/05/05.  Carried 4‑0‑1. Abstained 1 (Benson)



Motion Grothe, second Eberhart to approve the accounts payable of $52,378.03.  Carried 5‑0‑0.



Paul Qualy made comments on the following concerns: Truth in Taxation vs. Fees, Grover Site and Landmark’s ability to fulfill their obligations and if the water meters that are out for bids are in disrepair or outdated. 


Unfinished BUSINESS

7-A. City Personnel Policy Approval: 


There were two minor changes made to the city personnel policy that were discussed. The council discussed that this policy serves as a guideline for city employees and the policy can be amended as needed in the future to serve in the cities best interest.


      Motion Grothe, second Benson to approve the City of Zumbrota Personnel Policy. 

      Carried 5-0-0


7-B.  Police Department:


Mayor Bauer commented on the police department and the need to discuss the department in general.  Mayor Bauer stated that a committee of Police Chief Selness, City Administrator Jensen, Mayor Bauer and Councilmember Borgschatz will meet next week to bring back to the council priorities and a direction they feel the police department should focus on in the future.  






8-A.  Resolution 2005-12 Designating the National Incident Management System (NIMS)


Since 911, the federal government has been trying to establish a standardized command system in emergency situations.  NIMS will provide this system and in order to receive federal funding and the opportunity for additional grant monies the City of Zumbrota would need to adopt this system.


            Motion Eberhart, second Grothe to approve Resolution 2005-12 designating the National         Incident Management System (NIMS) Carried 5-0-0



8-B.  Resolution 2005-13 Approve Plans and Order Bids Jacobson Commercial Park


Bill Anderson from Yaggy-Colby Engineers has completed the plans for the Jacobson Commercial Park and has asked to order bids. 


            Motion Grothe, second Borgschatz to approve Resolution 2005-13 to approve plans and          order bids for the Jacobson Commercial Park.  Carried 4-0-1 (Benson)



8-C.  Schumacher Minor Subdivision Request 72-700-0160 (Old St. Paul Road)


Community Development Director Angie Bersaw explained to the council the request for the minor subdivision and that, if the area were to be developed as previously discussed, the minor subdivision would be included in the assessments. 


            Motion Grothe, second Benson to approve the Schumacher Minor Subdivision 72-700-            0160. Carried 5-0-0



8-D.  Jacobson Commercial Park Right-In Only Turn Lane:


Community Development Director Angie Bersaw discussed the situation with the right turn lane and asked that the issue be tabled until a firm commitment with the business was secured. Tabled.






8-E.  Former United Church Property Proposal Recommendation


Community Development Director Angie Bersaw discussed the proposals with the council and explained that the Church Task Force Committee has ranked the proposals, based on the RFP, and has made a recommendation to accept the Zumbro River Partners proposal to build two sets of townhomes, for a purchase price of $100,000.00.


Motion Borgschatz, second Eberhart to accept the Zumbro River Partners proposal build two sets of townhomes, with a purchase price of $100,000.00.  Comment:         Borgschatz asked if anyone else had received a letter from a resident of the area and a short discussion was held to consider the letter’s content.  Carried 5-0-0


8-F.  Health Insurance Renewals:


Discussion was held on the renewal rates for the city employee’s health insurance. City Administrator Neil Jensen and City Accountant Mary Rohe are looking into different insurance suppliers for quotes.  It will be brought back to the council when the quotes become available. Tabled.


8-G.  Liquor License Renewal:


The following businesses have applied for liquor licenses:

            Covered Bridge Supper Club Inc.                     On and Off Sale & Sunday Liquor

            Stary-Yerka Post VFW 5727                           Club and Sunday Liquor

            Zumbrota Golf Club                                          On Sale and Sunday Liquor

            Zumbrota Liquor Store                         On and Off Sale Liquor


Councilmember Benson asked Police Chief Selness if there were any violations with those applying for renewals. Police Chief commented that no violations were issued last year.


            Motion Grothe, second Benson to approve the 2005 Liquor License Renewals. Carried 5-        0-0


8-H.  Dehumidifiers-Wastewater Treatment Plant and Booster Station


Public Works Director Rick Lohmann reviewed with the council the need for dehumidifiers for the wastewater plant and the booster station.  It was stated that the humidity in these areas is a concern for the electronic equipment in the buildings.  Councilmember Borgschatz questioned that maybe air conditioning might be the answer.  Public Works Director Rick Lohmann stated that the problem is moisture not necessarily warm temperatures.  Public Works Director Rick Lohmann received two quotes from distributors.  The only difference in the quotes was the freight cost. 


Motion Benson, second Borgschatz to purchase two dehumidifiers HI-E Dry Model 100 and Model 195 from Northwestern Power and Equipment for the total cost of $4,350.00.  Carried 5-0-0


8-I.  Approve Part-Time Planning Intern:


Community Development Director Angie Bersaw discussed with the council the interviews with the candidates for the P/T Planning Intern.  There were two candidates interviewed for the position.  It is the recommendation to hire Jessica Arndt for the position.  She would start May 31, 2005 and work until the start of school in the fall.


            Motion Borgschatz, second Grothe, based on Community Development Director Angie             Bersaw’s recommendation, to hire Jessica Arndt for the planning intern at $8.00 per hour.             Carried 5-0-0


8-J.  Gravel Road Maintenance and Chloride Application


Public Works Director Rick Lohmann discussed the gravel road maintenance for the upcoming season.  It was discussed what the township has done in the past before the city took over the maintenance of the road.  It also was brought up as to how many applications would be applied in the summer.  The cost for a single application would stay the same as last year at $1,445.00. 


            Motion Eberhart, second Grothe to have Goodhue County apply chloride to the gravel roads, as they did last year, for the cost of $1,445.00.  Carried 5-0-0





City Accountant Mary Rohe-


City Accountant Mary Rohe reported that the Auditors are finishing up their work and would be coming to the next meeting.  The window coverings will be measured to fit and ordered in the near future.  City Accountant Mary Rohe asked the council to consider a mural to be painted on the wall in the commons area of the Town Hall.  She stated that there will be an artist convention  coming to Mazeppa and there is interest to paint the mural.. The cost would be between $2,000.00 and $5,000.00


-Public Works Director Rick Lohmann-


Public Works Director Rick Lohmann reported on the progress of the construction projects that will be done this summer, including the Mill and Overlay, Jacobson Commercial Park, Booster Station, Water Meter Project, West Ave. Reconstruction Project.  He also stated  that there has been a number of catch basins that needed repair and that they have been working on the repairs.








-Police Chief Selness-


Police Chief Gary Selness presented a seminar for the police department and requested that the council review and consider the opportunity.  He also stated that he has purchased narrow band radio equipment and the upgrade is close to complete.






Mayor Bauer adjourned the meeting at 6:52 p.m.
